I’m sympathetic to the argument that Friedsdorf makes, but it also seems to misunderstand the role of prosecutors and the reasons that appeals are often taken in these sorts of cases. Appellate cases aren’t just about the particular case and the particular issue being reviewed by the court of appeal, they are also about larger legal principles that will be applied in subsequent cases. And with respect to the AG and prosecutors, they likely have an ethical obligation to make the strongest case they can based on existing law.

You can’t argue that the other side is lawless and then turn around and say that an AG from your side shouldn’t enforce the law as it is on the books.

I saw it too at the checkout while getting stuff for my youngest college apt. And am I glad to have my house back, I really like the empty nest thing. The whole time he was back this summer I never knew when I went to the fridge if I would have any leftovers still in there (most times I wouldn’t). Now it’s back to knowing that what I left there or planned to eat would probably still be there. There is also the fact that I can run around the house pretty much naked again without worrying if he and his friends or girlfriend will be walking through the door. :-)

These folks got screwed by Blackjewel, I recognize and sympathize with that. But let’s not make this something more than it is, which is a lot of bitter workers looking for a final paycheck or their jobs back. They’d have better luck in a courtroom than sitting on train tracks and hoping that they “win” against Blackjewel before something comes along to break up the “strike” long enough for the train to get moving.

It’s just an attempt by Conor Friedersdorf
to run a story with a headline that will catch the eyes, because he knows this stance of his will resonate with a certain crowd (Berners) rather that really is a critique of Harris. Take this excerpt from the piece:

And I do not hold it against Harris that as a municipal and state official she enforced many laws that I regard as unjust. All the candidates now running for president will, if elected, preside over the enforcement of some laws that they and I regard as unjust.

Then what the hell really is the issue?

Sure, Conor goes on with his claims of “tests” that Harris supposedly fails. But all those tests fall under the typical problems of running a large government organ. Specifically, the person on top will, and usually has to for tractability, let the machinery of the bureaucracy run as a machine, rather have the person on top take a personal interest in every action.

What Conor is complaining about is that the California state attorneys pursued some actions of which Conor thinks Harris should have personally intervened.

But I think that is unreasonable.

There are millions, yes millions, of actions before the superior courts of California and the various organs of the state justice system (such as the prisons) and I am quite sure that there are many cases where in hindsight there was a miscarriage of what many of us believe to be the just thing.

But the likes of Conor wish to make the person at the top sound like they are personally for these unfortunate instances.

President Trump has suggested multiple times to senior Homeland Security and national security officials that they explore using nuclear bombs to stop hurricanes from hitting the United States, according to sources who have heard the president’s private remarks and been briefed on a National Security Council memorandum that recorded those comments.

Behind the scenes: During one hurricane briefing at the White House, Trump said, “I got it. I got it. Why don’t we nuke them?” according to one source who was there. “They start forming off the coast of Africa, as they’re moving across the Atlantic, we drop a bomb inside the eye of the hurricane and it disrupts it. Why can’t we do that?” the source added, paraphrasing the president’s remarks.

I don’t think that someone who thought Bernie could win in 2016 and who refused to vote for Obama in 2012 and apparently still thinks that there is little difference between Romney and Obama is worthy of consideration. Everyone is out there to Hillary Harris. The Bernie Bros are certainly all in on that.

I can appreciate all that. But most of the posts defending Harris don’t actually address the issues raised. We should be better than simply dismissing something because of the messenger.
